Saskatchewan man acquitted in child porn case


OTTAWA—The Supreme Court of Canada has overturned the child pornography conviction of a Saskatchewan man, after agreeing his rights were violated by an unreasonable search of his home computer.

Urbain P. Morelli claimed his charter rights were violated because his computer was searched by police after a visiting computer technician noticed two suspicious links on his home computer.

In a split, 4-3 decision, the high court acquitted Morelli after ruling police relied on a “carelessly drafted” and “misleading” search warrant.

The chain of events unfolded after the technician saw the links on Morelli’s computer after he visited the man’s La Ronge, Sask. home in September 2002 to install a high-speed Internet hookup.

The tech eventually went to police and the Mounties got a search warrant in January 2003.

The trial judge upheld the validity of the warrant and Morelli was given an 18-month conditional sentence in 2005.

By links I assume they mean bookmarks?
In which case the guy wasn't just checking/testing connectivity, he was looking through his personal shit.
Sure - the guys a fucking creep no doubt...(but that said without access to these kinds of pages - would he be a bigger one?), but if that was the only basis they had for seizure of his pc, someone essentially not doing their job right, well yeah I'd have to say that's more than likely why the courts ruled the way they did.
