Lawsuit???

Well I received a letter from an Attorney yesterday regarding our Haunted House from this past October. I cannot say it suprises me I did expect one eventually. A women is claiming her 12 year old Son has had terrifying nightmares since going through the haunt, has been unable to attend school on several occasions which has caused her to take off from work so he could sleep during the day, while it was light out. They are requesting lost wages, pay to have the kid go through counseling, and pay the Attorney fee's, or they will pursue the matter in court.

I am talking to an Attorney friend next week at his New Year's party, and he has offered to write us a letter free.

She claims that one of the actors grabbed her Son at the Texas Chainsaw/Leatherface scene, which scared him so bad the entire haunt has caused this condition.

I'm getting together some pictures of signs, and the actual signs we post about kids going through, and the fact that there are live actors who may come into contact with the patrons.

I'm hoping our past record and this evidence will make this go away, but we will see. Sure is a bummer to get this right before Christmas.

Just one more prime example of someone's refusal to accept responsibility for their own actions...This shit pisses me off more than anything else I can think of...

Ugh...I seriously have to try to restrain my anger in order to post this...

Did you drag the child, kicking and screaming, through your exhibit?...I'd be willing to bet that the mother was the one who brought the child, and/or allowed him to walk through it...So...Why isn't SHE the one who's responsible for her child's 'trauma'?

Don't you think that a mother should be familiar enough with her own child to determine whether or not he could handle an experience such as this?...If she wasn't, and she made a bad judgement call because of it, I can't imagine how that's YOUR fault...

If her child was scared, then you accomplished your goal...Your exhibit was a success...Was the mother unaware that the PURPOSE for a Halloween haunted house exhibit is to SCARE someone?.......I could just see that in court...

Irresponsible Parent: I took my child to a haunted house exhibit and it scared him
Judge: Why did you take him in the first place?
Irresponsible Parent: It was Halloween, he wanted to be scared

Hasn't she ever been to a haunted house?...Has she NO idea what is expected to happen?...If she was not aware of how things are done, then shame on her for allowing her child to do something that she hasn't determined the risk or safety of...The child is 12 years old...Not 5 or 6...If he were of a fragile psyche, he should never have been exposed to such a thing in the first place...Perhaps she should have taken him to a 'Mary had A Little Lamb' exhibit instead...

I'm not blaming the child, either...It's the parents who are SUPPOSED to be responsible until a child turns 18...Maybe she's just feeling guilty because she KNOWS that SHE allowed this to happen to her child...All children are different...My kids could (and DID) handle this shit when they were 5 years old, I knew them well enough to determine that not only would they be able to deal with it, but that they would also get a kick out of it, and absolutely love it...

My sister-in-law brought her 10 year-old son with us to a haunted house once when Wicked Lady was 5 years old...Freddy Kreuger went after him...He screamed and freaked out...Wicked lady laughed her ass off...She was so cute...lol...Anyway, he had nightmares for about a week after that, but my sister-in-law didn't sue anyone, nor did she take my nephew to a fucking psychiatrist :rolleyes:...Wicked Lady called him a wimp then...She STILL teases him about it sometimes, and now he's 21...It ended up being a funny memory...

I hope to hell that woman doesn't ever allow her child to watch a horror movie...Could you imagine the ridiculous lawsuits that would follow?...Yeah...We CAN imagine it...Unfortunately there are FAR too many people who will blame, movies, music, video games, television or ANYTHING for whatever ails them...

I am SO sick of this shit......But, I do have to say...This is at least something a little 'new'...I'm really sorry that it has caused you so much trouble...Just be glad that you didn't give them any coffee that they could have spilled on themselves, and I sincerely hope that you didn't provide any cookies, cupcakes, brownies or other refreshments that could have made them fat...You would have had more than one lawsuit on your hands:rolleyes: ...Yeah...I know how stupid that was...That's EXACTLY my point!

Thanks guys I appreciate the support. The PTO provided concessions, so hay maybe there will be more to come!

We even had a lights on walk-thru on Halloween for the younger TOT's where everything was very subdued. I'm hoping this will help our case

Well, sounds to me like you accomplished what you set out to do. Fucking scare people.

I have confidence that you have age warnings and such posted...so in my estimation (which counts for pretty much nothing), I think the onus is on the stupid bitch mother who took a 12 year old child to a haunted house...fully knowing that...HEY, this might be a little too scary for a 12 year old.

The only reason this pisses me off so much is because I was at a haunted amusement park this year, and this friggin' lady had like a 5-6 year old son with her who was crying and frightened the whole time. WTF???? There shouldn't even have to be any age warnings, etc. Use some common sense people.

People should know not to take kids into Haunted Houses if they expect the kids not to be scared..:rolleyes:
