What would you do?
 
I'm at Delaware Park yesterday and decided to use valet parking as it was really cold and it only cost $3.00.

OK, fine. Went into the casino, played some virtual Black Jack, a couple hours later come out because we're done and are ready for some lunch. I give the valet my ticket and he goes to get my car. There's a couple of ladies standing there also waiting for their car. Where I'm standing I can see the lot where the valets are bringing the cars from. I see this Volvo coming and then all of a sudden you can tell the car got hit from behind. The lady next to me says "That's my car!" I'm thinking "Poor lady". So, I'm still waiting for my car. It's not coming. I start getting that sick feeling in my stomach. I walk down to where the lady's Volvo is - you can't see the car behind it. Sure enough - it was my car that rear ended hers.

I started freaking out. OK, calmed down, just stood there looking at my car in disbelief. A lady comes up and says she saw the whole thing and that the valet in my car was speeding. Gave me her name and number.

The men from Delaware Park said they would take care of everything (damn right you are). However, Enterprise was already closed. So, here I sit without a car until Monday when they're going to come to my house and take me to Enterprise to get a rental.

Here's the reason for this post: I'm thinking about suing them since I have a witness that said the valet was speeding. What would you do? I've never sued anyone in my life.

Well, obviously expect them to pay for damage to both vehicles wether i had insurance or not, if this ment i had to sue them then i would be getting advice straight away!

Non of it is your fault what so ever, so if there's one single thing you have to pay for that's a bit out there and worth the time and effort then I see no reason you shouldn't.

I'm determined not to put out one cent for any of this. Or sign any papers. This is completely their fault and has nothing to do with me, other than the fact that it's my car.

Well, if they don't cooperatively take care of the problem(s) do what ya gotta do.

well if you do, then you shouldn't have anything to worry about, but of course you could always sue for neglagence on top of that. make the guy lose his job etc....

well, first try and sue and if that doesnt work. Find out where helives, kidnap his dog. Send pictures of them to his house under the name of "Slit-throat sammy". Send messages to his phone saying you can see him. Throw bricks at his car. It could make a great docudrama.

to be honest, i think you should. two reasons, 1, it was in no way your fault. You should not be put out at all for nay reason, the burden is theirs. Suing them insures that a judge makes sure they do what they are supposed to.

2. if nothing happens, then there is a chance that the person responsible may not suffer nay consequences, and may do ti again. suing them will also insure that the responsible party will probably either be reprimanded or fired, either way, they will probably not get the opportunity to do it again.
