Ok, as some of you already know, I made a remix song out of a clip of SaW, that slasherman posted here awhile back. Now, I have a question:

If I acknowledge the writers, and actors and state that the movie clip is still in their ownership, can I sell the song in which I have used the movie clip? If not, how would I go about being able to sell this song? If I put it up as a *bonus track* (basically a freebie), could I sell it on a CD?

thats a good question, because i made a couple of songs using movie samples too...

Then how are all of these people able to put these .WAV sound clips up for download from movies, without having any problems?

That's kind of common though. Youtube sucks. 90% of what winds up on there, gets deleted anyway.

i never tried to sell any.....i dont know if i could,like your wondering.

i think any project i work on is a solo one, it's just me.........

You can use other people's movie, clips, songs, etc only as long as you don't try to sell it for money.

If you want to sell it you need their permission, otherwise they could sue you.

Now you can take their ideas and make clips and songs yourself, you just can't copy everything word for word.

pretty sure you need legal permission.

What if I'm not *Selling* it?

does that still apply if the sample is sped up or slowed down?
i thought if it was changed alittle bit it was ok to use, i have a couple of friends that have movie clips in there songs and are selling them just fine.

Simply being, I have my album finished, and want to throw it on there as a freebie to everyone who actually listens to my music. I'm not planning on selling it as an actual track all alone. It would be my music they are buying, and they'd get that song for free.

i think once you record it as your own intellectual property - or whatever they call it ... (if it's made for public viewing/listening) it could still be a problem.

i know that Kevin Smith was asked to take down (on u-tube) some clips where he appeared in talk shows - he wasn't trying to sell those ..

Artists do that kind of stuff all the time...avoiding legal issues is one of many reasons. It's still illegal to use the clip without permission...but this way, it's less likely they'll find out;) .
