Son Gets Six Months Probation For Dismembering Mother

Buffalo, New York -- A teenager who said he killed and slowly dismembered his mother over several days at the urging of the 50-year-old man who was sexually abusing him was sentenced Monday to six months in jail.

Angel Rosa, 16, pleaded guilty in June to a first-degree manslaughter in the death of Madeline Irene, 46, whose head and hands were found encased in cement in a garbage can at the 50-year-old's home after other body parts were found floating in a nearby river.

Psychiatrists for both the prosecution and the defense determined Rosa was emotionally under the control of Edwin Gimenez, a convicted child molester who was his co-defendant in the homicide.

Rosa was also sentenced to five years probation. He has already spent 15 months in jail and will be released to the custody of a psychologist who had examined him while he was in jail, according to Assistant District Attorney Christopher Belling. The terms of his release are somewhat unusual, Belling said.

"It's been a very, very unusual case from the get-go,'' Belling said. "I think that justice was served.''

Gimenez, a convicted pedophile, was sentenced to 25 years to life in prison for convincing Rosa to kill his mother.

Rosa said he felt emotionally out of control when he killed his mother Aug. 18 and dismembered her in their apartment. He pleaded innocent to murder and conspiracy last fall.

Rosa had been accused of mixing drugs into his mother's food and drink and strangling her. The indictment said Gimenez allegedly worked with the teen to dismember and dispose of the body.

Authorities said they believe Gimenez befriended Rosa's family so he could sexually abuse Rosa and a younger boy, and that he convinced Rosa to kill his mother so Gimenez could take the boys to New York City.

Rosa faced a maximum prison term of nine years because he was 15 at the time of the killing. He will be sentenced in September.

Lock him up in the looney bin. He was clearly manipulated, but the emotional harm is going to destroy that kid eventually.
