Naked Dairy Fight Had No Artistic Merit, Court Finds
Domestic milk company stages nude performance in Insadong
The company, identified only as Ħ°SĦħ, was also indicted for employing three nude models during a promotional event at a gallery in Insa-dong in January 2003.
A Seoul appellate court on Friday sentenced an executive of a domestic milk company to a fine of about US$5,000 for staging a nude yogurt fight to advertise a new product.
The law defines 'licentious or lascivious acts' as behavior that stimulates the sexual desires of ordinary people and incites arousal, and this behavior may damage or distort the normal sense of shame that should accompany such acts, the court said in its ruling. This applies to the obscene act of young nude female models whose bodies are caked in wheat flour spraying each other with yogurt from vaporizers until the naked form underneath is revealed
The bench ruled the performance was purely commercially motivated and had no artistic merit whatsoever. It said the show, in which three nude models sprayed each other with yogurt, was obscene and sensational, adding it could find no justification for using nudity to achieve the goal of the campaign.
One model identified as Park, who also serves as head of the Korea Nude Models' Association, was fined US$2,000, while two other models were fined US$600 each.
