Can u believe how ridiculous this is? I meanthe fact that it WASNT declared a mistrial earlier....

A Texas appeals courts has overturned the murder conviction of Andrea Yates, the Houston-area woman who drowned her five children in her home's bathtub.

The 1st Court of Appeals in a decision released early Thursday, ruled the trial judge should have declared a mistrial after a state expert witness said Yates based the killings on a television show, but it was later shown the program's episode never existed, the Houston Chronicle reported on its Web site.

A new trial was ordered for Yates.

Yates, in 2001, confessed to killing her five children, aged from 7 years to 6 months, by drowning them. She pleaded innocent by reason of insanity, and her attorneys claimed postpartum depression played a role in the killings. Those attorneys said Yates, who was under psychiatric care, didn't know right from wrong when she killed the children.

She was convicted in the deaths of three of the children and the jury suggested she be sentenced to life in prison. Yates was not tried for the deaths of the other two children.
